Pochopen\u00ed koncepce na\u0159\u00edzen\u00ed o VLEP je nezbytn\u00e9 pro zaji\u0161t\u011bn\u00ed bezpe\u010dnosti pracovn\u00edk\u016f vystaven\u00fdch potenci\u00e1ln\u011b nebezpe\u010dn\u00fdm chemick\u00fdm l\u00e1tk\u00e1m. <\/p>\n\n<h2 class=\"wp-block-heading\"><strong>Co je to expozi\u010dn\u00ed limit na pracovi\u0161ti?<\/strong><\/h2>\n\n<h3 class=\"wp-block-heading\"><strong>Definice p\u0159edpis\u016f VLEP<\/strong><\/h3>\n\n<figure class=\"wp-block-image alignleft size-full is-resized\"><img decoding=\"async\" width=\"400\" height=\"400\" src=\"https:\/\/obera.fr\/wp-content\/uploads\/2023\/12\/vlep.jpg\" alt=\"vlep\" class=\"wp-image-26580\" style=\"width:226px;height:auto\" srcset=\"https:\/\/obera.fr\/wp-content\/uploads\/2023\/12\/vlep.jpg 400w, https:\/\/obera.fr\/wp-content\/uploads\/2023\/12\/vlep-300x300.jpg 300w, https:\/\/obera.fr\/wp-content\/uploads\/2023\/12\/vlep-150x150.jpg 150w\" sizes=\"(max-width: 400px) 100vw, 400px\" \/><\/figure>\n\n<p><strong>Limitn\u00ed hodnota expozice p\u0159i pr\u00e1ci (<\/strong>OELV) je maxim\u00e1ln\u00ed koncentrace chemick\u00e9 l\u00e1tky v ovzdu\u0161\u00ed, kterou m\u016f\u017ee \u010dlov\u011bk vdechovat bez ohro\u017een\u00ed zdrav\u00ed. VLEP stanovuje Ministerstvo pr\u00e1ce, zam\u011bstnanosti a integrace a reviduje je podle stavu pozn\u00e1n\u00ed. Jsou n\u00e1strojem prevence zdravotn\u00edch rizik na pracovi\u0161ti a slou\u017e\u00ed jako m\u011b\u0159\u00edtko pro technick\u00e9 kontroly vy\u017eadovan\u00e9 z\u00e1konem (vyhl\u00e1\u0161ka \u010d. 2009-1570 ze dne 15. prosince 2009). <strong>Zam\u011bstnavatel\u00e9 jsou povinni<\/strong> dodr\u017eovat limity VLEP stanoven\u00e9 <strong>v \u010dl\u00e1nc\u00edch L.4121-1 a n\u00e1sleduj\u00edc\u00edch a L.4221-1 francouzsk\u00e9ho z\u00e1kon\u00edku pr\u00e1ce<\/strong>.   <\/p>\n\n<p>C\u00edlem <strong>na\u0159\u00edzen\u00ed VLEP<\/strong> je stanovit expozi\u010dn\u00ed limity pro chemick\u00e9 l\u00e1tky p\u0159\u00edtomn\u00e9 v pracovn\u00edm prost\u0159ed\u00ed. Tyto limity jsou stanoveny za \u00fa\u010delem ochrany zam\u011bstnanc\u016f p\u0159ed \u0161kodliv\u00fdmi \u00fa\u010dinky chemick\u00fdch l\u00e1tek na jejich zdrav\u00ed. Dodr\u017eov\u00e1n\u00edm t\u011bchto limit\u016f zam\u011bstnavatel\u00e9 pom\u00e1haj\u00ed p\u0159edch\u00e1zet nemocem z povol\u00e1n\u00ed spojen\u00fdm s expozic\u00ed chemick\u00fdm l\u00e1tk\u00e1m.  <\/p>\n\n<p>Stru\u010dn\u011b \u0159e\u010deno, VLEP je \u00farove\u0148 koncentrace chemick\u00fdch l\u00e1tek v ovzdu\u0161\u00ed pracovi\u0161\u0165, kter\u00e1 nesm\u00ed b\u00fdt v dan\u00e9m obdob\u00ed p\u0159ekro\u010dena. Je to referen\u010dn\u00ed hodnota pro posouzen\u00ed \u00farovn\u011b expozice v ovzdu\u0161\u00ed. Vyjad\u0159uje se v :  <\/p>\n\n<ul class=\"wp-block-list\">\n<li>(mg\/m3 nebo mg chemick\u00fdch l\u00e1tek na m3 vzduchu) pro plyny, p\u00e1ry a kapaln\u00e9 a pevn\u00e9 aerosoly;<\/li>\n\n\n\n<li>(ppm, tj. \u010d\u00e1stic na milion) pro plyny a p\u00e1ry;<\/li>\n\n\n\n<li>f\/cm3 (vl\u00e1kna na cm3) pro vl\u00e1knit\u00e9 materi\u00e1ly.<\/li>\n<\/ul>\n\n<h3 class=\"wp-block-heading\"><strong>Princip na\u0159\u00edzen\u00ed VLEP<\/strong><\/h3>\n\n<p>Mezi hlavn\u00ed prvky, kter\u00fdmi se \u0159\u00edd\u00ed p\u0159edpisy VLEP, pat\u0159\u00ed <strong>definice dot\u010den\u00fdch chemick\u00fdch l\u00e1tek, stanoven\u00ed specifick\u00fdch expozi\u010dn\u00edch limit\u016f, uveden\u00ed kontroln\u00edch a monitorovac\u00edch opat\u0159en\u00ed a metody hodnocen\u00ed rizik<\/strong>. Tyto prvky jsou \u010dasto podrobn\u011b pops\u00e1ny v z\u00e1kon\u00edku pr\u00e1ce nebo v p\u0159edpisech jednotliv\u00fdch zem\u00ed. <\/p>\n\n<p>Zam\u011bstnavatel\u00e9 jsou ze z\u00e1kona povinni dodr\u017eovat na\u0159\u00edzen\u00ed VLEP. Zam\u011bstnavatel\u00e9 mus\u00ed <strong>identifikovat chemick\u00e9 l\u00e1tky p\u0159\u00edtomn\u00e9 na pracovi\u0161ti, posoudit souvisej\u00edc\u00ed rizika, zav\u00e9st vhodn\u00e1 preventivn\u00ed a ochrann\u00e1 opat\u0159en\u00ed, informovat a \u0161kolit zam\u011bstnance<\/strong> a <strong>prov\u00e1d\u011bt pravideln\u00e9 kontroly,<\/strong> aby zajistili dodr\u017eov\u00e1n\u00ed expozi\u010dn\u00edch limit\u016f. <\/p>\n\n<h2 class=\"wp-block-heading\">P\u0159edpisy VLEP: omezuj\u00edc\u00ed nebo orienta\u010dn\u00ed mezn\u00ed hodnoty<\/h2>\n\n<p>VLEP m\u016f\u017ee stanovit Ministerstvo pr\u00e1ce, zam\u011bstnanosti a integrace nebo je m\u016f\u017ee doporu\u010dit CNAMTS (Caisse nationale de l&#8217;assurance maladie des travailleurs salari\u00e9s).<\/p>\n\n<p><strong>VLEP<\/strong> se rozli\u0161uj\u00ed <strong>podle sv\u00e9 povahy<\/strong>:<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Regula\u010dn\u00ed <\/strong>(rozd\u00edl mezi regula\u010dn\u00edm a orienta\u010dn\u00edm VLEP) ;<\/li>\n\n\n\n<li><strong>Technick\u00e1 <\/strong>(VLEP 8h nebo VLEP kr\u00e1tkodob\u00fd).<\/li>\n<\/ul>\n\n<h3 class=\"wp-block-heading\">Z\u00e1vazn\u00e9 regula\u010dn\u00ed mezn\u00ed hodnoty<\/h3>\n\n<p><strong>Omezuj\u00edc\u00ed limitn\u00ed hodnoty jsou stanoveny vyhl\u00e1\u0161kou<\/strong> a za\u010dlen\u011bny do z\u00e1kon\u00edku pr\u00e1ce:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>V \u010dl\u00e1nku R.4412-149 jsou v tabulce uvedeny n\u011bkter\u00e9 nebezpe\u010dn\u00e9 chemick\u00e9 l\u00e1tky (DCA), jako jsou l\u00e1tky CMR (karcinogenn\u00ed a\/nebo mutagenn\u00ed a\/nebo toxick\u00e9 pro reprodukci), nap\u0159. oxid uhelnat\u00fd, <a href=\"https:\/\/obera.fr\/conseils\/vlep-chrome-hexavalent-valeurs-limites-exposition-professionnelle-contraignantes\/\">oxid chromit\u00fd<\/a>, olovo atd.<\/li>\n\n\n\n<li>\u010cl\u00e1nek R.4412-100 stanov\u00ed z\u00e1vazn\u00fd VLEP pro azbestov\u00e1 vl\u00e1kna;<\/li>\n\n\n\n<li>\u010cl\u00e1nek R.4222-10 stanov\u00ed omezuj\u00edc\u00ed VLEP pro celkov\u00fd a respirabiln\u00ed prach <strong>;<\/strong><\/li>\n\n\n\n<li>\u010cl\u00e1nek R.4412-154 a \u010dl\u00e1nek R.4412-155 stanov\u00ed omezuj\u00edc\u00ed OEL pro krystalick\u00fd oxid k\u0159emi\u010dit\u00fd.<\/li>\n<\/ul>\n\n<p>Z\u00e1vazn\u00e9 hodnoty ELV <strong>nesm\u00ed b\u00fdt p\u0159ekro\u010deny <\/strong>, v opa\u010dn\u00e9m p\u0159\u00edpad\u011b hroz\u00ed trestn\u00ed postih.<\/p>\n\n<h3 class=\"wp-block-heading\">Orienta\u010dn\u00ed regula\u010dn\u00ed mezn\u00ed hodnoty<\/h3>\n\n<p><strong>Orienta\u010dn\u00ed mezn\u00ed hodnoty jsou stanoveny vyhl\u00e1\u0161kou<\/strong>. Jsou ur\u010deny jako <strong>minim\u00e1ln\u00ed preventivn\u00ed c\u00edl, kter\u00e9ho<\/strong> m\u00e1 b\u00fdt dosa\u017eeno. <\/p>\n\n<h3 class=\"wp-block-heading\">8hodinov\u00fd VLEP<\/h3>\n\n<p>8hodinov\u00e1 limitn\u00ed hodnota expozice na pracovi\u0161ti (8h OELV) je maxim\u00e1ln\u00ed \u00farove\u0148<strong> expozice<\/strong> m\u011b\u0159en\u00e1 po <strong>dobu 8hodinov\u00e9 pracovn\u00ed sm\u011bny<\/strong>. Dodr\u017eov\u00e1n\u00ed 8hodinov\u00e9 OEL zabra\u0148uje rizik\u016fm opo\u017ed\u011bn\u00e9ho \u00fa\u010dinku zp\u016fsoben\u00fdm chemick\u00fdmi \u010diniteli. <\/p>\n\n<h3 class=\"wp-block-heading\">Kr\u00e1tkodob\u00fd VLEP<\/h3>\n\n<p>Kr\u00e1tkodob\u00e1 limitn\u00ed hodnota expozice na pracovi\u0161ti (STEV) je <strong>maxim\u00e1ln\u00ed \u00farove\u0148 m\u011b\u0159en\u00e1 po referen\u010dn\u00ed dobu 15 minut<\/strong>. Dodr\u017een\u00ed STOEL zabra\u0148uje riziku toxick\u00fdch \u00fa\u010dink\u016f b\u011bhem kr\u00e1tk\u00e9 doby. <\/p>\n\n<h2 class=\"wp-block-heading\"><strong>Sledov\u00e1n\u00ed regulace VLEP<\/strong><\/h2>\n\n<p>P\u0159edpisy t\u00fdkaj\u00edc\u00ed se kontroly VLEP se \u0159\u00edd\u00ed :<\/p>\n\n<ul class=\"wp-block-list\">\n<li>\u010cl\u00e1nky R.4412-27 a\u017e R.4412-31 francouzsk\u00e9ho z\u00e1kon\u00edku pr\u00e1ce pro nebezpe\u010dn\u00e9 chemick\u00e9 l\u00e1tky (ACD);<\/li>\n\n\n\n<li>\u010cl\u00e1nky R.4412-76 a\u017e R.4412-80 pro chemick\u00e9 l\u00e1tky klasifikovan\u00e9 jako CMR ;<\/li>\n\n\n\n<li>Vyhl\u00e1\u0161ka \u010d. 2009-1570 ze dne 15. prosince 2009 o kontrole chemick\u00fdch rizik na pracovi\u0161ti.<\/li>\n<\/ul>\n\n<p>Tyto z\u00e1kony definuj\u00ed <strong>postupy m\u011b\u0159en\u00ed <\/strong>a <strong>syst\u00e9m akreditace kontroln\u00edch org\u00e1n\u016f<\/strong>.<\/p>\n\n<h3 class=\"wp-block-heading\">Postupy pro monitorov\u00e1n\u00ed VLEP<\/h3>\n\n<p>Podle vyhl\u00e1\u0161ky \u010d. 2009-1570 ze dne 15. prosince 2009 mus\u00ed b\u00fdt testov\u00e1ny <strong>v\u0161echny chemick\u00e9 l\u00e1tky s <\/strong>povinn\u00fdm nebo orienta\u010dn\u00edm regula\u010dn\u00edm <strong>VLEP <\/strong>. <strong>Chemick\u00e9 \u010dinitele CMR klasifikovan\u00e9 jako 1A nebo 1B s regula\u010dn\u00edm VLEP<\/strong> mus\u00ed b\u00fdt systematicky <strong>kontrolov\u00e1ny akreditovan\u00fdm subjektem<\/strong> nejm\u00e9n\u011b jednou ro\u010dn\u011b nebo v\u017edy, kdy\u017e dojde k jak\u00e9koli zm\u011bn\u011b, kter\u00e1 by mohla m\u00edt nep\u0159\u00edzniv\u00fd vliv na expozici pracovn\u00edk\u016f. Stejn\u00e9 pravidlo plat\u00ed pro <strong>nebezpe\u010dn\u00e9 chemick\u00e9 \u010dinitele (HCA) s regulovan\u00fdm VLEP<\/strong>, pokud z hodnocen\u00ed proveden\u00e9ho zam\u011bstnavatelem nevypl\u00fdv\u00e1 n\u00edzk\u00e9 riziko pro zdrav\u00ed zam\u011bstnanc\u016f.  <\/p>\n\n<p><strong>V\u00fdsledky monitorov\u00e1n\u00ed atmosf\u00e9ry<\/strong> se zaznamen\u00e1vaj\u00ed do <strong>n\u00e1rodn\u00ed datab\u00e1ze<\/strong> (datab\u00e1ze SCOLA spravovan\u00e1 INRS) a z\u016fst\u00e1vaj\u00ed k dispozici :<\/p>\n\n<ul class=\"wp-block-list\">\n<li>pracovn\u00ed l\u00e9ka\u0159 ;<\/li>\n\n\n\n<li>CHSCT ;<\/li>\n\n\n\n<li>inspektor\u00e1t pr\u00e1ce ;<\/li>\n\n\n\n<li>inspektor prac\u00ed ;<\/li>\n\n\n\n<li>pracovn\u00edci preventivn\u00edch odd\u011blen\u00ed organizac\u00ed soci\u00e1ln\u00edho zabezpe\u010den\u00ed.<\/li>\n<\/ul>\n\n<p>Pozn\u00e1mka: <strong>podm\u00ednky pro m\u011b\u0159en\u00ed pra\u0161nosti<\/strong> a monitorov\u00e1n\u00ed VLEP na azbest jsou definov\u00e1ny v \u010dl\u00e1nc\u00edch R.4412-104 a n\u00e1sleduj\u00edc\u00edch francouzsk\u00e9ho z\u00e1kon\u00edku pr\u00e1ce.<strong> Celkov\u00e9 monitorov\u00e1n\u00ed pra\u0161nosti<\/strong> se \u0159\u00edd\u00ed \u010dl\u00e1nky R.4722-1, R.4722-2, R.4724-2 a R.4724-3 francouzsk\u00e9ho z\u00e1kon\u00edku pr\u00e1ce. <\/p>\n\n<h3 class=\"wp-block-heading\"><strong>Kontroln\u00ed org\u00e1ny VLEP<\/strong><\/h3>\n\n<figure class=\"wp-block-image alignleft size-full is-resized\"><img decoding=\"async\" width=\"900\" height=\"900\" src=\"https:\/\/obera.fr\/wp-content\/uploads\/2023\/12\/cofrac.jpg\" alt=\"cofrac\" class=\"wp-image-26583\" style=\"width:147px;height:auto\" srcset=\"https:\/\/obera.fr\/wp-content\/uploads\/2023\/12\/cofrac.jpg 900w, https:\/\/obera.fr\/wp-content\/uploads\/2023\/12\/cofrac-300x300.jpg 300w, https:\/\/obera.fr\/wp-content\/uploads\/2023\/12\/cofrac-150x150.jpg 150w, https:\/\/obera.fr\/wp-content\/uploads\/2023\/12\/cofrac-768x768.jpg 768w\" sizes=\"(max-width: 900px) 100vw, 900px\" \/><\/figure>\n\n<p><strong>Zkou\u0161ky VLEP <\/strong>mus\u00ed prov\u00e1d\u011bt <strong>nez\u00e1visl\u00fd subjekt akreditovan\u00fd<\/strong> francouzskou akredita\u010dn\u00ed komis\u00ed (Cofrac). Technick\u00e1 kontrola VLEP zahrnuje 4 slu\u017eby: <\/p>\n\n<ul class=\"wp-block-list\">\n<li>Stanoven\u00ed strategie v\u00fdb\u011bru vzork\u016f ;<\/li>\n\n\n\n<li>Odb\u011br vzork\u016f;<\/li>\n\n\n\n<li>Anal\u00fdza vzork\u016f ;<\/li>\n\n\n\n<li>Diagnostika, zda byly spln\u011bny nebo p\u0159ekro\u010deny limitn\u00ed hodnoty expozice na pracovi\u0161ti.<\/li>\n<\/ul>\n\n<h2 class=\"wp-block-heading\"><strong>Sankce za nedodr\u017een\u00ed p\u0159edpis\u016f VLEP<\/strong><\/h2>\n\n<p>Nedodr\u017een\u00ed p\u0159edpis\u016f VLEP m\u016f\u017ee m\u00edt pro spole\u010dnosti pr\u00e1vn\u00ed d\u016fsledky a sankce. P\u0159\u00edslu\u0161n\u00e9 org\u00e1ny mohou v p\u0159\u00edpad\u011b nedodr\u017een\u00ed p\u0159edpis\u016f ulo\u017eit pokuty, pozastavit \u010dinnost spole\u010dnosti nebo zah\u00e1jit trestn\u00ed \u0159\u00edzen\u00ed. Pro zam\u011bstnavatele je proto z\u00e1sadn\u00ed, aby tyto normy d\u016fsledn\u011b dodr\u017eovali a zajistili tak bezpe\u010dnost a ochranu zdrav\u00ed sv\u00fdch zam\u011bstnanc\u016f.  <\/p>\n\n<h3 class=\"wp-block-heading\"><strong>P\u0159ekro\u010den\u00ed TLV v r\u00e1mci spole\u010dnosti<\/strong><\/h3>\n\n<figure class=\"wp-block-image alignright size-large is-resized\"><img decoding=\"async\" width=\"1024\" height=\"1024\" src=\"https:\/\/obera.fr\/wp-content\/uploads\/2023\/12\/panneau-stop-1024x1024.jpg\" alt=\"zna&#x10D;ka stop\" class=\"wp-image-26587\" style=\"width:131px;height:auto\" srcset=\"https:\/\/obera.fr\/wp-content\/uploads\/2023\/12\/panneau-stop-1024x1024.jpg 1024w, https:\/\/obera.fr\/wp-content\/uploads\/2023\/12\/panneau-stop-300x300.jpg 300w, https:\/\/obera.fr\/wp-content\/uploads\/2023\/12\/panneau-stop-150x150.jpg 150w, https:\/\/obera.fr\/wp-content\/uploads\/2023\/12\/panneau-stop-768x768.jpg 768w, https:\/\/obera.fr\/wp-content\/uploads\/2023\/12\/panneau-stop-1536x1536.jpg 1536w, https:\/\/obera.fr\/wp-content\/uploads\/2023\/12\/panneau-stop.jpg 1920w\" sizes=\"(max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n\n<p>V p\u0159\u00edpad\u011b <strong>p\u0159ekro\u010den\u00ed z\u00e1vazn\u00fdch regula\u010dn\u00edch VLEP<\/strong> mus\u00ed zam\u011bstnavatel :<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Zastavit pr\u00e1ci na dan\u00fdch pracovi\u0161t\u00edch<\/strong> a\u017e do proveden\u00ed nezbytn\u00fdch opat\u0159en\u00ed na ochranu zam\u011bstnanc\u016f v p\u0159\u00edpad\u011b, \u017ee se jedn\u00e1 o pracovn\u00edka kategorie 1A nebo 1B CMR (\u010dl\u00e1nek R.4412-77 francouzsk\u00e9ho z\u00e1kon\u00edku pr\u00e1ce);<\/li>\n\n\n\n<li>P\u0159ijmout <strong>okam\u017eit\u00e1 opat\u0159en\u00ed na ochranu zam\u011bstnanc\u016f v p\u0159\u00edpad\u011b ACD <\/strong>(\u010dl\u00e1nky R.4412-11 a R.4412-12 francouzsk\u00e9ho z\u00e1kon\u00edku pr\u00e1ce).<\/li>\n<\/ul>\n\n<p>Pokud <strong>je p\u0159ekro\u010dena orienta\u010dn\u00ed hodnota VLEP<\/strong>, mus\u00ed zam\u011bstnavatel prov\u00e9st<strong>hodnocen\u00ed rizik, <\/strong>aby ur\u010dil vhodn\u00e1 preventivn\u00ed a ochrann\u00e1 opat\u0159en\u00ed:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>V souladu s \u010dl\u00e1nkem R.4412-78 francouzsk\u00e9ho z\u00e1kon\u00edku pr\u00e1ce, v p\u0159\u00edpad\u011b kategorie 1A nebo 1B CMR ;<\/li>\n\n\n\n<li>V souladu s \u010dl\u00e1nkem R.4412-29 francouzsk\u00e9ho z\u00e1kon\u00edku pr\u00e1ce v p\u0159\u00edpad\u011b ACD.<\/li>\n<\/ul>\n\n<h3 class=\"wp-block-heading\"><strong>D\u016fsledky pro spole\u010dnost<\/strong><\/h3>\n\n<p>Zam\u011bstnavatel\u00e9 jsou ze z\u00e1kona povinni zajistit bezpe\u010dnost a ochranu zdrav\u00ed sv\u00fdch zam\u011bstnanc\u016f (\u010dl\u00e1nek L.4121-1 francouzsk\u00e9ho z\u00e1kon\u00edku pr\u00e1ce). Tato povinnost zahrnuje prov\u00e1d\u011bn\u00ed preventivn\u00edch, informa\u010dn\u00edch a \u0161kolic\u00edch opat\u0159en\u00ed. V jej\u00edm r\u00e1mci mus\u00ed zam\u011bstnavatel pravideln\u011b prov\u00e1d\u011bt hodnocen\u00ed pracovn\u00edch rizik na ka\u017ed\u00e9m pracovi\u0161ti, kter\u00e9 zahrnuje technick\u00e9 kontroly VLEP. Zam\u011bstnavatel\u00e9 mohou b\u00fdt pohn\u00e1ni k odpov\u011bdnosti, pokud nepln\u00ed sv\u00e9 povinnosti vypl\u00fdvaj\u00edc\u00ed z p\u0159edpis\u016f VLEP.   <\/p>\n\n<p>Pokud dojde k p\u0159ekro\u010den\u00ed povinn\u00e9 VLEP, vystavuje se zam\u011bstnavatel trestn\u00edmu postihu :<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Pokuta a\u017e do v\u00fd\u0161e 10 000 eur;<\/li>\n\n\n\n<li>Jeden rok odn\u011bt\u00ed svobody a pokuta 30 000 eur za opakovan\u00e9 poru\u0161en\u00ed z\u00e1kona.<\/li>\n<\/ul>\n\n<p>Pokuta se ulo\u017e\u00ed tolikr\u00e1t, kolik zam\u011bstnanc\u016f bylo p\u0159estupkem posti\u017eeno (\u010dl\u00e1nek L4741-1 z\u00e1kon\u00edku pr\u00e1ce). V <strong>p\u0159\u00edpad\u011b nemoci z povol\u00e1n\u00ed nebo pracovn\u00edho \u00farazu<\/strong> (ke kter\u00e9mu do\u0161lo nebo m\u016f\u017ee doj\u00edt) je zam\u011bstnavatel <strong>odpov\u011bdn\u00fd podle ob\u010dansk\u00e9ho pr\u00e1va<\/strong>. V souladu s pravidly obecn\u00e9ho pr\u00e1va (\u010dl\u00e1nek 1231-1 francouzsk\u00e9ho ob\u010dansk\u00e9ho z\u00e1kon\u00edku) mus\u00ed zam\u011bstnavatel, kter\u00fd nespln\u00ed svou povinnost v oblasti bezpe\u010dnosti, <strong>nahradit zam\u011bstnanci ve\u0161kerou zp\u016fsobenou \u0161kodu <\/strong>(v\u010detn\u011b \u0161kody zp\u016fsoben\u00e9 \u00fazkost\u00ed). <\/p>\n\n<h3 class=\"wp-block-heading\"><strong>Dodr\u017eov\u00e1n\u00ed p\u0159edpis\u016f<\/strong><\/h3>\n\n<p>Pro spln\u011bn\u00ed po\u017eadavk\u016f na\u0159\u00edzen\u00ed VLEP mus\u00ed spole\u010dnosti prov\u00e9st \u0159adu krok\u016f. Nejprve mus\u00ed prov\u00e9st <strong>posouzen\u00ed chemick\u00fdch rizik <\/strong>specifick\u00fdch pro jejich pracovn\u00ed prost\u0159ed\u00ed. D\u00e1le mus\u00ed zav\u00e9st <strong>vhodn\u00e1 preventivn\u00ed a kontroln\u00ed opat\u0159en\u00ed,<\/strong> jako je pou\u017e\u00edv\u00e1n\u00ed n\u00e1hradn\u00edch l\u00e1tek, v\u011btr\u00e1n\u00ed a \u0161kolen\u00ed pracovn\u00edk\u016f. Nakonec je nezbytn\u00e9 <strong>prov\u00e1d\u011bt pravideln\u00e9 audity,<\/strong> aby bylo zaji\u0161t\u011bno trval\u00e9 dodr\u017eov\u00e1n\u00ed limit\u016f expozice a v p\u0159\u00edpad\u011b pot\u0159eby aktualizovat kontroln\u00ed opat\u0159en\u00ed.   <\/p>\n\n<p>Auditn\u00ed a kontroln\u00ed procesy hraj\u00ed z\u00e1sadn\u00ed roli p\u0159i dodr\u017eov\u00e1n\u00ed p\u0159edpis\u016f VLEP. Tyto audity ov\u011b\u0159uj\u00ed prov\u00e1d\u011bn\u00ed preventivn\u00edch opat\u0159en\u00ed, sleduj\u00ed \u00farove\u0148 expozice, identifikuj\u00ed oblasti pro zlep\u0161en\u00ed a zaji\u0161\u0165uj\u00ed dodr\u017eov\u00e1n\u00ed stanoven\u00fdch norem. Audity mohou prov\u00e1d\u011bt intern\u00ed nebo extern\u00ed org\u00e1ny specializovan\u00e9 na bezpe\u010dnost a ochranu zdrav\u00ed p\u0159i pr\u00e1ci.  <\/p>\n\n<h2 class=\"wp-block-heading\"><strong>Zm\u011bny na\u0159\u00edzen\u00ed o VLEP<\/strong><\/h2>\n\n<p>P\u0159edpisy VLEP \u010del\u00ed <strong>neust\u00e1l\u00fdm<\/strong> v\u00fdzv\u00e1m a <strong>zm\u011bn\u00e1m<\/strong>. Technologick\u00fd a v\u011bdeck\u00fd pokrok a nov\u00e9 chemick\u00e9 l\u00e1tky pou\u017e\u00edvan\u00e9 v pr\u016fmyslu znamenaj\u00ed, \u017ee je t\u0159eba pravideln\u011b aktualizovat expozi\u010dn\u00ed limity a kontroln\u00ed opat\u0159en\u00ed. P\u0159\u00edslu\u0161n\u00e9 org\u00e1ny mus\u00ed z\u016fstat bd\u011bl\u00e9 a reagovat na nov\u00e9 v\u00fdzvy v oblasti bezpe\u010dnosti a ochrany zdrav\u00ed p\u0159i pr\u00e1ci.    <\/p>\n\n<p>Z\u00e1v\u011brem lze \u0159\u00edci, \u017ee <strong>p\u0159edpisy VLEP<\/strong> maj\u00ed z\u00e1sadn\u00ed v\u00fdznam pro hodnocen\u00ed a kontrolu chemick\u00fdch rizik na pracovi\u0161ti. Zam\u011bstnavatel\u016fm p\u0159in\u00e1\u0161\u00ed v\u00fdznamn\u00e9 v\u00fdhody v oblasti zdrav\u00ed, bezpe\u010dnosti a dobr\u00e9 pov\u011bsti. Dodr\u017eov\u00e1n\u00edm z\u00e1konn\u00fdch povinnost\u00ed a ochranou zam\u011bstnanc\u016f mohou spole\u010dnosti zajistit bezpe\u010dn\u00e9 a zdrav\u00e9 pracovn\u00ed prost\u0159ed\u00ed.
