Definition of terms used in the privacy policy

In the following, we will refer to :

The purpose of this charter is to inform you of the Site’s commitments with regard to the respect of your privacy and the protection of your Personal Data collected and processed during your use of the Service.

Article 2 – Data collected on the Site

The Data collected and subsequently processed by the Site are those that you voluntarily transmit to us by filling in the various forms on the Site. For certain content-related operations, you may be asked to transmit your personal data to third-party partners through their own services, more specifically when making payments. We will not have access to this data, as its collection and processing are governed by the conditions specific to these parties. We invite you to consult their conditions before communicating your Data in this context.

Your IP address (the identification number assigned to your computer on the Internet) is collected automatically. The Publisher’s collection of Users’ Personal Data does not require any declaration to the French Data Protection Authority (Commission Nationale de l’Informatique et des Libertés – CNIL).

Article 3 – Identity of the data controller

The data controller is oberA, whose registered office is at 4 Rue Denis Papin 67400 Illkirch-Graffenstaden.

Article 4 – Purpose of the Data collected

The Data identified as mandatory on the Site’s forms is required in order to benefit from the Site’s corresponding functionalities, and more specifically from the operations on the content offered within the Site.

The Site may collect and process User Data:

  • To provide you with the information or services to which you have subscribed, in particular: Newsletter dispatch.
  • To gather information that will enable us to improve our site, products and services (in particular through the use of cookies).
  • For the purpose of contacting you regarding : Web project.

Article 5 – Recipients and use of collected Data

The Data collected by us are processed for the purposes of carrying out operations on the contents of the Service.

Only oberA will receive your Personal Information. This information is never passed on to a third party, notwithstanding the subcontractors oberA uses. Neither oberA nor its subcontractors market the personal data of visitors and users of its Site.

Your personal data may be shared with the parties listed below for the purposes set out in this privacy policy.

We require all third parties to guarantee the security of your personal data and to treat it in accordance with the law. We do not allow our third-party service providers to use your data.

Article 6 – Legal basis for data processing

In accordance with the General Data Protection Regulation (GDPR), oberA only processes personal data in the following situations:

  • with your consent;
  • when there is a contractual obligation (a contract between oberA and you);
  • to meet a legal obligation (under EU or national legislation).

Article 7 – Data security

You are informed that your Data may be disclosed in application of a law, regulation or by virtue of a decision by a competent regulatory or judicial authority or, if necessary, for the purposes of the Publisher’s rights and interests.

We have implemented appropriate security measures to prevent your personal data from being accidentally lost, used, modified, disclosed or accessed without authorization. In addition, access to your personal data is subject to a defined and documented security procedure.

Generally speaking, oberA undertakes to use the data collected in strict compliance with current legislation, and in particular with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, known as the RGPD.

Article 8 – Data retention period

The Data is stored by the site host, whose contact details are given in the Site’s legal notice, and is kept for the period strictly necessary to achieve the aforementioned purposes, which may not exceed 36 months. After this period, they will be kept exclusively for statistical purposes and will not be used in any way whatsoever.

Article 9 – Authorized service providers and transfer to a non-EU country

oberA informs you that it has recourse to authorized service providers to facilitate the collection and processing of the data you have communicated to us. These service providers may be located outside the European Union and may receive data collected via the various forms on the Site.

oberA has previously ensured that its service providers implement adequate safeguards and comply with strict conditions regarding confidentiality, usage and data protection. In particular, vigilance has focused on the existence of a legal basis for any data transfer to a third country. In this respect, some of our service providers are subject to internal company rules (or “Binding Corporate Rules”) that were approved by the CNIL in 2016 when the others obey not only Standard Contractual Clauses but also the Privacy Shield.

oberA will be entitled, if necessary, to oppose requests that are manifestly abusive due to their systematic, repetitive or numerous nature.

We may ask you for specific information in order to confirm your identity and to ensure your right of access to your personal data (or to exercise any other right). This is a security measure to ensure that personal data is not delivered to anyone not authorized to receive it. We can also contact you to obtain more information about your request, so that we can give you a quicker response.

We try to respond to all legitimate requests within one month. This one-month period may be exceeded if your request is particularly complex, or if you have submitted several requests. In this case, we will notify you and keep you informed.
