Tie ir l\u012bdzeklis vesel\u012bbas risku nov\u0113r\u0161anai darbaviet\u0101 un kalpo k\u0101 krit\u0113rijs likum\u0101 (2009. gada 15. decembra Dekr\u0113ts Nr. 2009-1570) noteiktaj\u0101m tehniskaj\u0101m p\u0101rbaud\u0113m. <strong>Darba dev\u0113jiem<\/strong> ir j\u0101iev\u0113ro VLEP ierobe\u017eojumi, k\u0101 noteikts <strong>Francijas Darba kodeksa L.4121-1 un turpm\u0101kajos pantos un L.4221-1<\/strong>. pant\u0101.   <\/p>\n\n<p><strong>VLEP regulas<\/strong> m\u0113r\u0137is ir noteikt darba vid\u0113 eso\u0161o \u0137\u012bmisko vielu iedarb\u012bbas robe\u017ev\u0113rt\u012bbas. \u0160\u012bs robe\u017ev\u0113rt\u012bbas ir noteiktas, lai aizsarg\u0101tu darbiniekus pret \u0137\u012bmisko vielu kait\u012bgo ietekmi uz vi\u0146u vesel\u012bbu. Iev\u0113rojot \u0161os ierobe\u017eojumus, darba dev\u0113ji pal\u012bdz nov\u0113rst arodslim\u012bbas, kas saist\u012btas ar \u0137\u012bmisko vielu iedarb\u012bbu.  <\/p>\n\n<p>\u012asi sakot, VLEP ir \u0137\u012bmisko a\u0123entu koncentr\u0101cijas l\u012bmenis darba vietu atmosf\u0113r\u0101, kuru nedr\u012bkst p\u0101rsniegt noteikt\u0101 laika posm\u0101. T\u0101 ir atsauces v\u0113rt\u012bba, lai nov\u0113rt\u0113tu iedarb\u012bbas l\u012bmeni gais\u0101. To izsaka :  <\/p>\n\n<ul class=\"wp-block-list\">\n<li>(mg\/m3 vai mg \u0137\u012bmisko vielu uz m3 gaisa) g\u0101z\u0113m, tvaikiem un \u0161\u0137idrajiem un cietajiem aerosoliem;<\/li>\n\n\n\n<li>(ppm, t. i., miljonda\u013cas) g\u0101z\u0113m un tvaikiem;<\/li>\n\n\n\n<li>f\/cm3 (\u0161\u0137iedras uz cm3) \u0161\u0137iedrainiem materi\u0101liem.<\/li>\n<\/ul>\n\n<h3 class=\"wp-block-heading\"><strong>VLEP noteikumu princips<\/strong><\/h3>\n\n<p>Galvenie elementi, kas reglament\u0113 VLEP noteikumus, ietver <strong>attiec\u012bgo \u0137\u012bmisko vielu defin\u012bciju, konkr\u0113tu iedarb\u012bbas robe\u017ev\u0113rt\u012bbu noteik\u0161anu, kontroles un monitoringa pas\u0101kumu izkl\u0101stu un riska nov\u0113rt\u0113\u0161anas metodes<\/strong>. \u0160ie elementi bie\u017ei vien ir s\u012bki izkl\u0101st\u012bti Darba kodeks\u0101 vai konkr\u0113tai valstij specifiskos noteikumos. <\/p>\n\n<p>Darba dev\u0113jiem ir juridisks pien\u0101kums iev\u0113rot VLEP noteikumus. Darba dev\u0113jiem ir <strong>j\u0101identific\u0113 darba viet\u0101 eso\u0161\u0101s \u0137\u012bmisk\u0101s vielas, j\u0101nov\u0113rt\u0113 ar t\u0101m saist\u012btie riski, j\u0101\u012bsteno atbilsto\u0161i profilakses un aizsardz\u012bbas pas\u0101kumi, j\u0101inform\u0113 un j\u0101apm\u0101ca darbinieki<\/strong>, k\u0101 ar\u012b <strong>j\u0101veic regul\u0101ras p\u0101rbaudes,<\/strong> lai nodro\u0161in\u0101tu, ka tiek iev\u0113rotas iedarb\u012bbas robe\u017ev\u0113rt\u012bbas. <\/p>\n\n<h2 class=\"wp-block-heading\">VLEP noteikumi: ierobe\u017eojo\u0161as vai indikat\u012bvas robe\u017ev\u0113rt\u012bbas<\/h2>\n\n<p>VLEP var noteikt Darba, nodarbin\u0101t\u012bbas un integr\u0101cijas ministrija vai ieteikt CNAMTS (Caisse nationale de l&#8217;assurance maladie des travailleurs salari\u00e9s).<\/p>\n\n<p><strong>VLEP<\/strong> iz\u0161\u0137ir <strong>p\u0113c to veida<\/strong>:<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Regulat\u012bvie <\/strong>(at\u0161\u0137ir\u012bba starp regulat\u012bvo un indikat\u012bvo VLEP) ;<\/li>\n\n\n\n<li><strong>Tehnisk\u0101 <\/strong>(VLEP 8h vai VLEP \u012bstermi\u0146a).<\/li>\n<\/ul>\n\n<h3 class=\"wp-block-heading\">Saisto\u0161\u0101s reglament\u0113t\u0101s robe\u017ev\u0113rt\u012bbas<\/h3>\n\n<p><strong>Ierobe\u017eojo\u0161\u0101s robe\u017ev\u0113rt\u012bbas tiek noteiktas ar dekr\u0113tu<\/strong> un iek\u013cautas Darba kodeks\u0101:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>R.4412-149. pant\u0101 tabul\u0101 ir uzskait\u012bti da\u017ei b\u012bstamie \u0137\u012bmiskie a\u0123enti (DCA), piem\u0113ram, CMR a\u0123enti (kancerog\u0113ni un\/vai mutag\u0113ni, un\/vai reprodukt\u012bvajai funkcijai toksiski), piem\u0113ram, oglek\u013ca monoks\u012bds, <a href=\"https:\/\/obera.fr\/conseils\/vlep-chrome-hexavalent-valeurs-limites-exposition-professionnelle-contraignantes\/\">hroma trioks\u012bds<\/a>, svins utt.<\/li>\n\n\n\n<li>R.4412-100. pant\u0101 noteikts saisto\u0161s VLEP azbesta \u0161\u0137iedr\u0101m;<\/li>\n\n\n\n<li>R.4222-10. pant\u0101 ir noteikts ierobe\u017eojo\u0161s VLEP attiec\u012bb\u0101 uz kop\u0113jiem un ieelpojamiem putek\u013ciem <strong>;<\/strong><\/li>\n\n\n\n<li>R.4412-154. pant\u0101 un R.4412-155. pant\u0101 ir noteikts ierobe\u017eojo\u0161s OEL krist\u0101liskajam sil\u012bcija dioks\u012bdam.<\/li>\n<\/ul>\n\n<p>Saisto\u0161\u0101s robe\u017ev\u0113rt\u012bbas <strong>nedr\u012bkst p\u0101rsniegt <\/strong>, pret\u0113j\u0101 gad\u012bjum\u0101 tiks piem\u0113roti krimin\u0101lsodi.<\/p>\n\n<h3 class=\"wp-block-heading\">Orient\u0113jo\u0161\u0101s normat\u012bvajos aktos noteikt\u0101s robe\u017ev\u0113rt\u012bbas<\/h3>\n\n<p><strong>Indikat\u012bv\u0101s robe\u017ev\u0113rt\u012bbas ir noteiktas ar dekr\u0113tu<\/strong>. T\u0101s ir paredz\u0113tas k\u0101 <strong>minim\u0101lais<\/strong> sasniedzamais <strong>prevent\u012bvais m\u0113r\u0137is<\/strong>. <\/p>\n\n<h3 class=\"wp-block-heading\">8 stundu VLEP<\/h3>\n\n<p>asto\u0146u stundu arodekspoz\u012bcijas robe\u017ev\u0113rt\u012bba (8h OELV) ir maksim\u0101lais<strong> ekspoz\u012bcijas<\/strong> l\u012bmenis, ko m\u0113ra <strong>8 stundu darba mai\u0146as<\/strong> laik\u0101. Atbilst\u012bba 8 stundu OEL nov\u0113r\u0161 \u0137\u012bmisko a\u0123entu izrais\u012bto nov\u0113lotas iedarb\u012bbas risku. <\/p>\n\n<h3 class=\"wp-block-heading\">\u012astermi\u0146a VLEP<\/h3>\n\n<p>\u012astermi\u0146a arodekspoz\u012bcijas robe\u017ev\u0113rt\u012bba (STEV) ir <strong>maksim\u0101lais l\u012bmenis, kas izm\u0113r\u012bts 15 min\u016b\u0161u ilg\u0101 atskaites period\u0101<\/strong>. Atbilst\u012bba STEV nov\u0113r\u0161 toksiskas iedarb\u012bbas risku \u012bs\u0101 laika posm\u0101. <\/p>\n\n<h2 class=\"wp-block-heading\"><strong>VLEP regul\u0113juma uzraudz\u012bba<\/strong><\/h2>\n\n<p>Ar VLEP kontroli saist\u012btos noteikumus reglament\u0113 :<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Francijas Darba kodeksa R.4412-27 l\u012bdz R.4412-31 pants par b\u012bstam\u0101m \u0137\u012bmisk\u0101m viel\u0101m (ACD);<\/li>\n\n\n\n<li>R.4412-76.R.4412-80. pants par \u0137\u012bmiskaj\u0101m viel\u0101m, kas klasific\u0113tas k\u0101 CMR ;<\/li>\n\n\n\n<li>2009. gada 15. decembra Dekr\u0113ts Nr. 2009-1570 par \u0137\u012bmisko risku kontroli darba viet\u0101.<\/li>\n<\/ul>\n\n<p>\u0160ajos ties\u012bbu aktos ir noteiktas <strong>m\u0113r\u012b\u0161anas proced\u016bras <\/strong>un <strong>akredit\u0101cijas sist\u0113ma kontroles iest\u0101d\u0113m<\/strong>.<\/p>\n\n<h3 class=\"wp-block-heading\">VLEP uzraudz\u012bbas proced\u016bras<\/h3>\n\n<p>Saska\u0146\u0101 ar 2009. gada 15. decembra Dekr\u0113tu Nr. 2009-1570 <strong>visi \u0137\u012bmiskie a\u0123enti ar <\/strong>oblig\u0101tu vai indikat\u012bvu reglament\u0113tu <strong>VLEP <\/strong>ir j\u0101p\u0101rbauda. <strong>CMR a\u0123entiem, kas klasific\u0113ti k\u0101 1A vai 1B kategorijas ar reglament\u0113to VLEP<\/strong>, ir sistem\u0101tiski j\u0101veic <strong>akredit\u0113tas iest\u0101des p\u0101rbaudes<\/strong> vismaz reizi gad\u0101 vai ikreiz, kad ir k\u0101das izmai\u0146as, kas var nelabv\u0113l\u012bgi ietekm\u0113t iedarb\u012bbu uz darba \u0146\u0113m\u0113jiem. Tas pats noteikums attiecas uz <strong>b\u012bstamiem \u0137\u012bmiskiem a\u0123entiem (HCA) ar reglament\u0113tu VLEP<\/strong>, ja vien darba dev\u0113ja veiktais nov\u0113rt\u0113jums neliecina par zemu risku darba \u0146\u0113m\u0113ju vesel\u012bbai.  <\/p>\n\n<p><strong>Atmosf\u0113ras monitoringa rezult\u0101ti<\/strong> tiek re\u0123istr\u0113ti <strong>valsts datub\u0101z\u0113<\/strong> (SCOLA datub\u0101ze, ko p\u0101rvalda INRS) un ir pieejami :<\/p>\n\n<ul class=\"wp-block-list\">\n<li>arodslim\u012bbu \u0101rsts ;<\/li>\n\n\n\n<li>no CHSCT ;<\/li>\n\n\n\n<li>darba inspekcija ;<\/li>\n\n\n\n<li>darbu inspektors;<\/li>\n\n\n\n<li>soci\u0101l\u0101 nodro\u0161in\u0101juma organiz\u0101ciju profilakses noda\u013cu darbinieki.<\/li>\n<\/ul>\n\n<p>Piez\u012bme: <strong>nosac\u012bjumi<\/strong> azbesta <strong>putek\u013cu l\u012bme\u0146a m\u0113r\u012b\u0161anai<\/strong> un VLEP uzraudz\u012bbai ir noteikti Francijas Darba kodeksa R.4412-104. un turpm\u0101kajos pantos.<strong> Kop\u0113jo putek\u013cu monitoringu<\/strong> reglament\u0113 Francijas Darba kodeksa R.4722-1, R.4722-2, R.4724-2 un R.4724-3 pants. <\/p>\n\n<h3 class=\"wp-block-heading\"><strong>VLEP kontroles iest\u0101des<\/strong><\/h3>\n\n<figure class=\"wp-block-image alignleft size-full is-resized\"><img decoding=\"async\" width=\"900\" height=\"900\" src=\"https:\/\/obera.fr\/wp-content\/uploads\/2023\/12\/cofrac.jpg\" alt=\"cofrac\" class=\"wp-image-26583\" style=\"width:147px;height:auto\" srcset=\"https:\/\/obera.fr\/wp-content\/uploads\/2023\/12\/cofrac.jpg 900w, https:\/\/obera.fr\/wp-content\/uploads\/2023\/12\/cofrac-300x300.jpg 300w, https:\/\/obera.fr\/wp-content\/uploads\/2023\/12\/cofrac-150x150.jpg 150w, https:\/\/obera.fr\/wp-content\/uploads\/2023\/12\/cofrac-768x768.jpg 768w\" sizes=\"(max-width: 900px) 100vw, 900px\" \/><\/figure>\n\n<p><strong>VLEP test\u0113\u0161ana <\/strong>j\u0101veic <strong>neatkar\u012bgai iest\u0101dei, ko akredit\u0113jusi<\/strong> Francijas akredit\u0101cijas komiteja (Cofrac). VLEP tehnisk\u0101 p\u0101rbaude ietver 4 pakalpojumus: <\/p>\n\n<ul class=\"wp-block-list\">\n<li>Paraugu \u0146em\u0161anas strat\u0113\u0123ijas noteik\u0161ana ;<\/li>\n\n\n\n<li>Paraugu \u0146em\u0161ana;<\/li>\n\n\n\n<li>Paraugu anal\u012bze ;<\/li>\n\n\n\n<li>Diagnoze par to, vai ir sasniegtas vai p\u0101rsniegtas arodekspoz\u012bcijas robe\u017ev\u0113rt\u012bbas.<\/li>\n<\/ul>\n\n<h2 class=\"wp-block-heading\"><strong>Sankcijas par VLEP noteikumu neiev\u0113ro\u0161anu<\/strong><\/h2>\n\n<p>VLEP noteikumu neiev\u0113ro\u0161ana var rad\u012bt juridiskas sekas un sodus uz\u0146\u0113mumiem. Neatbilst\u012bbas gad\u012bjum\u0101 kompetent\u0101s iest\u0101des var uzlikt naudas sodu, aptur\u0113t uz\u0146\u0113muma darb\u012bbu vai uzs\u0101kt krimin\u0101lprocesu. Darba dev\u0113jus var saukt pie atbild\u012bbas, ja tie nepilda savus pien\u0101kumus saska\u0146\u0101 ar VLEP noteikumiem.   <\/p>\n\n<p>Ja tiek p\u0101rsniegts oblig\u0101tais VLEP, krimin\u0101lsods paredz darba dev\u0113jam :<\/p>\n\n<ul class=\"wp-block-list\">\n<li>naudas sods l\u012bdz 10 000 eiro;<\/li>\n\n\n\n<li>Par atk\u0101rtotiem p\u0101rk\u0101pumiem &#8211; br\u012bv\u012bbas at\u0146em\u0161ana uz vienu gadu un 30 000 eiro naudas sods.<\/li>\n<\/ul>\n\n<p>Naudas sods tiek piem\u0113rots tik rei\u017eu, cik darbinieku p\u0101rk\u0101pums ir sk\u0101ris (Darba kodeksa L4741-1. pants). <strong>Arodslim\u012bbas vai nelaimes gad\u012bjuma darb\u0101<\/strong> (kas ir noticis vai var notikt) <strong>gad\u012bjum\u0101<\/strong> darba dev\u0113js ir <strong>civiltiesiski atbild\u012bgs<\/strong>. Saska\u0146\u0101 ar visp\u0101r\u0113jo ties\u012bbu norm\u0101m (Francijas Civilkodeksa 1231-1. pants) darba dev\u0113jam, kas nepilda savus dro\u0161\u012bbas pien\u0101kumus, ir <strong>j\u0101atl\u012bdzina darbiniekam nodar\u012btais kait\u0113jums <\/strong>(tostarp ar trauksmi saist\u012btais kait\u0113jums). <\/p>\n\n<h3 class=\"wp-block-heading\"><strong>Atbilst\u012bba<\/strong><\/h3>\n\n<p>Lai izpild\u012btu VLEP noteikumus, uz\u0146\u0113mumiem ir j\u0101veic vair\u0101ki pas\u0101kumi. Pirmk\u0101rt, tiem ir j\u0101veic <strong>\u0137\u012bmisko vielu riska nov\u0113rt\u0113jums, kas <\/strong>rakstur\u012bgs to darba videi. P\u0113c tam j\u0101ievie\u0161 <strong>atbilsto\u0161i profilakses un kontroles pas\u0101kumi,<\/strong> piem\u0113ram, aizst\u0101j\u0113ju izmanto\u0161ana, ventil\u0101cija un darbinieku apm\u0101c\u012bba.
