Se consider\u0103 c\u0103 numai expunerea la concentra\u021bii mai mari sau pe o perioad\u0103 mai lung\u0103 de timp va avea consecin\u021be asupra s\u0103n\u0103t\u0103\u021bii.  <\/p>\n\n<h2 class=\"wp-block-heading\">Cum sunt setate TLV-urile?<\/h2>\n\n<p>\u00cencep\u00e2nd cu Directiva 98\/24\/CE, VLEP au fost stabilite pe baza unei evalu\u0103ri \u0219tiin\u021bifice a rela\u021biei dintre efectele asupra s\u0103n\u0103t\u0103\u021bii ale substan\u021belor periculoase \u0219i nivelul de expunere profesional\u0103. Perioada de referin\u021b\u0103 pentru stabilirea TLV-urilor este fie de 8 ore pentru TLV-urile de 8 ore, fie de 15 minute pentru TLV-urile pe termen scurt. <\/p>\n\n<h2 class=\"wp-block-heading\">Care sunt diferitele tipuri de VLEP?<\/h2>\n\n<p>Exist\u0103 dou\u0103 <a href=\"https:\/\/obera.fr\/ro\/sfatul-nostru\/reglementation-vlep-evaluation-risque-chimique-lieu-de-travail\/\" data-type=\"post\" data-id=\"6575\">tipuri de valori limit\u0103 de reglementare<\/a>:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>VLEP restrictiv, care, chiar \u0219i la niveluri sc\u0103zute de expunere, constituie<strong>  un risc pentru s\u0103n\u0103tate. Fie c\u0103 este vorba despre o cutie, o sond\u0103 sau un analizor de aer, dispozitivul trebuie s\u0103 fie amplasat \u00een locul \u00een care este prezent poluantul. Aceste dispozitive diferite vor analiza aerul \u0219i vor determina cantitatea \u0219i tipul de poluant prezent \u00een aerul din spa\u021biul dumneavoastr\u0103 de lucru. Rezultatele controalelor aerului sunt apoi \u00eenregistrate \u00eentr-o baz\u0103 de date na\u021bional\u0103<strong>(baza de date SCOLA<\/strong>), care va permite autorit\u0103\u021bilor publice s\u0103 utilizeze aceste statistici.   <\/p>\n<\/div>\n<\/div>\n\n<p>Rezultatele m\u0103sur\u0103torilor \u0219i monitoriz\u0103rii atmosferice sunt comunicate medicului de medicina muncii \u0219i <strong>CHSCT<\/strong>. Acestea contribuie la evaluarea riscurilor care decurg din expunerea la agen\u021bi chimici \u0219i ajut\u0103 la determinarea m\u0103surilor preventive adecvate. <\/p>\n\n<h3 class=\"wp-block-heading\">Cine poate monitoriza VLEP?<\/h3>\n\n<p>\u00cen general, orice persoan\u0103 care de\u021bine un analizor de aer poate verifica VLE prezente \u00een incinta sa. Cu toate acestea, \u00een ochii legii, testul dvs. nu va avea nicio valoare pentru c\u0103 nu sunte\u021bi acreditat. De aceea, este esen\u021bial s\u0103 apela\u021bi la organisme acreditate de COFRAC (Comit\u00e9 Fran\u00e7ais d&#8217;Accr\u00e9ditation). Aceste organisme, care sunt independente de \u00eentreprinderile \u00een care se efectueaz\u0103 inspec\u021biile tehnice, sunt acreditate s\u0103 stabileasc\u0103 <strong>strategia de m\u0103surare<\/strong>, s\u0103 preleveze probe \u0219i s\u0103 efectueze analize.   <\/p>\n\n<h2 class=\"wp-block-heading\">Cum s\u0103 preveni\u021bi expunerea la substan\u021be chimice periculoase \u0219i CMR la locul de munc\u0103?<\/h2>\n\n<div class=\"wp-block-columns are-vertically-aligned-center is-layout-flex wp-container-core-columns-is-layout-28f84493 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-vertically-aligned-center is-layout-flow wp-block-column-is-layout-flow\" style=\"flex-basis:25%\">\n<figure class=\"wp-block-image aligncenter size-full\"><img decoding=\"async\" width=\"150\" height=\"150\" src=\"https:\/\/obera.fr\/wp-content\/uploads\/2020\/11\/CMR.jpg\" alt=\"Fi&#x219;&#x103; cu date de securitate - Substan&#x21B;&#x103; chimic&#x103;\" class=\"wp-image-1832\"\/><\/figure>\n<\/div>\n\n\n\n<div class=\"wp-block-column is-vertically-aligned-center is-layout-flow wp-block-column-is-layout-flow\" style=\"flex-basis:75%\">\n<p>\u00cen conformitate cu decretul \u0219i ordinele din 15 decembrie 2009, angajatorul trebuie s\u0103 efectueze o evaluare a riscurilor prin m\u0103surarea calit\u0103\u021bii aerului cel pu\u021bin o dat\u0103 pe an \u0219i ori de c\u00e2te ori exist\u0103 o schimbare care poate afecta expunerea angaja\u021bilor.<\/p>\n<\/div>\n<\/div>\n\n<h2 class=\"wp-block-heading\">Este obligatorie conformitatea cu VLEP?<\/h2>\n\n<p>Da, dep\u0103\u0219irea unui VLEP de reglementare restrictiv trebuie s\u0103 conduc\u0103 la : <\/p>\n\n<ul class=\"wp-block-list\">\n<li>\u00cen cazul unui agent chimic, altul dec\u00e2t CMR 1A sau 1B, sau al prafului total sau respirabil, aplicarea imediat\u0103 a <strong>m\u0103surilor de protec\u021bie<\/strong> (articolele R. 4412-28 \u0219i R. 4412-29),<\/li>\n\n\n\n<li>\u00cen cazul unui agent chimic clasificat \u00een categoria CMR 1A sau 1B,<strong>oprirea activit\u0103\u021bii<\/strong> la posturile de lucru \u00een cauz\u0103 p\u00e2n\u0103 la punerea \u00een aplicare a m\u0103surilor de protec\u021bie a angaja\u021bilor (articolele R. 4412-77 \u0219i R. 4412-78).<\/li>\n<\/ul>\n\n<p>Dac\u0103 se dep\u0103\u0219e\u0219te un VLEP de reglementare indicativ, trebuie efectuat\u0103 o nou\u0103 <strong>evaluare a riscurilor<\/strong> pentru a determina m\u0103surile adecvate de prevenire \u0219i protec\u021bie.<\/p>\n\n<h2 class=\"wp-block-heading\">Ce trebuie f\u0103cut \u00een cazul \u00een care sunt dep\u0103\u0219ite TLV-urile companiei?<\/h2>\n\n<div class=\"wp-block-columns is-layout-flex wp-container-core-columns-is-layout-28f84493 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\" style=\"flex-basis:33.33%\">\n<figure class=\"wp-block-image aligncenter size-full is-resized\"><img decoding=\"async\" src=\"https:\/\/obera.fr\/wp-content\/uploads\/2022\/07\/VLEP.jpg\" alt=\"vlep\" class=\"wp-image-13688\" width=\"200\" height=\"200\" srcset=\"https:\/\/obera.fr\/wp-content\/uploads\/2022\/07\/VLEP.jpg 400w, https:\/\/obera.fr\/wp-content\/uploads\/2022\/07\/VLEP-300x300.jpg 300w, https:\/\/obera.fr\/wp-content\/uploads\/2022\/07\/VLEP-150x150.jpg 150w\" sizes=\"(max-width: 200px) 100vw, 200px\" \/><\/figure>\n<\/div>\n\n\n\n<div class=\"wp-block-column is-vertically-aligned-center is-layout-flow wp-block-column-is-layout-flow\" style=\"flex-basis:75%\">\n<p>\u00cen cazul \u00een care VLEP \u00een cauz\u0103 este o limit\u0103 de <strong>reglementare restrictiv\u0103<\/strong>, punerea imediat\u0103 \u00een aplicare a m\u0103surilor preventive pentru<strong> HCA <\/strong>(agen\u021bi chimici periculo\u0219i) \u0219i oprirea complet\u0103 a posturilor de lucru \u00een cauz\u0103, p\u00e2n\u0103 la punerea \u00een aplicare a m\u0103surilor \u0219i protec\u021biei adecvate pentru <strong><a href=\"https:\/\/obera.fr\/ro\/sfatul-nostru\/substances-cmr-risque-exposition-au-travail-quelle-reglementation-prevention\/\" data-type=\"post\" data-id=\"6581\">CMR<\/a><\/strong>.<\/p>\n\n\n\n<p>  \u00cen cazul \u00een care VLEP \u00een cauz\u0103 este <strong>indicativ<\/strong>, angajatorul efectueaz\u0103 o evaluare a riscurilor pentru a determina m\u0103surile adecvate de prevenire \u0219i protec\u021bie.<\/p>\n<\/div>\n<\/div>\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>De asemenea, merit\u0103 citit: <a href=\"https:\/\/obera.fr\/ro\/sfatul-nostru\/vlep-quels-risques-cas-de-non-respect-reglementation\/\" data-type=\"post\" data-id=\"1816\">Care sunt riscurile nerespect\u0103rii VLEP?<\/a><\/p>\n<\/blockquote>\n\n<p>Inspectorul sau controlorul de munc\u0103 poate, de asemenea, s\u0103 solicite \u00eentreprinderii ca VLEP de reglementare s\u0103 fie verificat de un organism acreditat.<\/p>\n\n<p>Organismul acreditat \u00ee\u0219i va defini strategia de e\u0219antionare, care va reprezenta \u00eentreaga perioad\u0103 \u00een care angajatul este expus, pentru a implementa ac\u021biuni corective care vor fi apoi verificate periodic.<\/p>\n\n<p>\u00cen timpul primei campanii de m\u0103surare (cel pu\u021bin trei m\u0103sur\u0103tori per GEH &#8211; grup de expunere omogen), dac\u0103 toate rezultatele sunt mai mici de 10% din VLEP stabilit, riscul de dep\u0103\u0219ire a acestuia este zero \u0219i, prin urmare, nu este obligatorie efectuarea celorlalte dou\u0103 campanii.<\/p>\n\n<p>\u00cen cazul \u00een care TLV sunt dep\u0103\u0219ite, trebuie luate m\u0103suri corective c\u00e2t mai cur\u00e2nd posibil \u0219i trebuie repetat\u0103 evaluarea ini\u021bial\u0103.<\/p>\n\n<p>Dac\u0103 rezultatul m\u0103sur\u0103rii se situeaz\u0103 \u00eentre 10% din TLV \u0219i <a href=\"https:\/\/obera.fr\/ro\/sfatul-nostru\/vlep-cobalt-et-composes-valeurs-limites-exposition-professionnelle\/\" data-type=\"post\" data-id=\"6351\">TLV<\/a>, campania de m\u0103surare continu\u0103. La sf\u00e2r\u0219itul celei de-a treia campanii de m\u0103surare, rezultatele ob\u021binute sunt analizate, din nou pe baza calculelor statistice. Prin urmare, este posibil s\u0103 se deduc\u0103 probabilitatea de dep\u0103\u0219ire a acestor VLEP \u0219i punerea \u00een aplicare a principiilor generale de prevenire.  <\/p>\n\n<p>Angajatorii sunt obliga\u021bi s\u0103 \u00eentocmeasc\u0103 un inventar al tuturor produselor chimice manipulate \u00een incinta lor, s\u0103 evalueze riscurile \u0219i s\u0103 \u00ee\u0219i instruiasc\u0103 angaja\u021bii. Ace\u0219tia trebuie s\u0103 formalizeze rezultatele pentru fiecare operator sub forma unei fi\u0219e de expunere personal\u0103 \u00een care sunt enumerate toate m\u0103sur\u0103torile \u0219i rezultatele. Aceste fi\u0219e sunt depuse la medicul de \u00eentreprindere. Toate garajele, cur\u0103\u021b\u0103toriile, t\u00e2mpl\u0103riile, IMM-urile, marile grupuri, \u00eentreprinderile de cur\u0103\u021benie etc. sunt vizate de aceast\u0103 reglementare.   <\/p>\n\n<h2 class=\"wp-block-heading\">Care sunt riscurile pentru angajatorii care nu \u00ee\u0219i \u00eendeplinesc aceste obliga\u021bii?<\/h2>\n\n<p>Angajatorii au o responsabilitate uria\u0219\u0103.
