De\u0219i legisla\u021bia francez\u0103 nu stabile\u0219te un prag precis pentru temperaturile maxime la locul de munc\u0103, exist\u0103 standarde \u0219i recomand\u0103ri care ofer\u0103 un cadru pentru siguran\u021ba termic\u0103 \u0219i previn pericolele asociate c\u0103ldurii excesive. Articolul R4223-13 din Codul muncii prevede c\u0103 angajatorul trebuie &#8222;s\u0103 asigure securitatea \u0219i s\u0103 protejeze s\u0103n\u0103tatea lucr\u0103torilor&#8221;, dar nu define\u0219te o limit\u0103 de temperatur\u0103 care s\u0103 nu fie dep\u0103\u0219it\u0103. Prin urmare, legea nu specific\u0103 valori stricte, l\u0103s\u00e2nd la latitudinea angajatorilor <strong>s\u0103 asigure condi\u021bii de munc\u0103 sigure<\/strong> \u00een func\u021bie de caracteristicile mediului lor.  <\/p>\n\n<p>De\u0219i legisla\u021bia nu stabile\u0219te o temperatur\u0103 maxim\u0103, exist\u0103 o serie de standarde \u0219i recomand\u0103ri pentru a ghida practicile angajatorilor \u00een ceea ce prive\u0219te gestionarea c\u0103ldurii la locul de munc\u0103.<\/p>\n\n<h3 class=\"wp-block-heading\">Standarde \u0219i recomand\u0103ri existente<\/h3>\n\n<h4 class=\"wp-block-heading\">Standardul ISO 7730  <\/h4>\n\n<div class=\"wp-block-columns is-layout-flex wp-container-core-columns-is-layout-28f84493 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\" style=\"flex-basis:66.66%\">\n<p><strong>Standardul ISO 7730<\/strong>, care se aplic\u0103 la proiectarea spa\u021biilor, define\u0219te<strong> condi\u021biile pentru confortul termic \u00een mediile interioare<\/strong>. Recomand\u0103rile sale sunt urm\u0103toarele: <\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>20 \u0219i 22 de grade \u00eentr-un birou ;<\/li>\n\n\n\n<li>16 p\u00e2n\u0103 la 18 grade \u00eentr-un atelier cu activitate fizic\u0103 medie ;<\/li>\n\n\n\n<li>14 &#8211; 16 grade pentru activitate fizic\u0103 sus\u021binut\u0103.<\/li>\n<\/ul>\n\n\n\n<p>Aceste intervale de temperatur\u0103 sunt considerate optime pentru<strong> asigurarea confortului termic<\/strong> f\u0103r\u0103 a perturba productivitatea angaja\u021bilor. Aceste recomand\u0103ri se aplic\u0103 \u00een principal mediilor cu aer condi\u021bionat sau bine ventilate. <\/p>\n\n\n\n<p><\/p>\n<\/div>\n\n\n\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\" style=\"flex-basis:33.33%\">\n<figure class=\"wp-block-image aligncenter size-large is-resized\"><img decoding=\"async\" width=\"1024\" height=\"1024\" src=\"https:\/\/obera.fr\/wp-content\/uploads\/2025\/03\/conseil-raf-1024x1024.png\" alt=\"Standarde\" class=\"wp-image-77456\" style=\"width:207px;height:auto\" srcset=\"https:\/\/obera.fr\/wp-content\/uploads\/2025\/03\/conseil-raf-1024x1024.png 1024w, https:\/\/obera.fr\/wp-content\/uploads\/2025\/03\/conseil-raf-300x300.png 300w, https:\/\/obera.fr\/wp-content\/uploads\/2025\/03\/conseil-raf-150x150.png 150w, https:\/\/obera.fr\/wp-content\/uploads\/2025\/03\/conseil-raf-768x768.png 768w, https:\/\/obera.fr\/wp-content\/uploads\/2025\/03\/conseil-raf.png 1200w\" sizes=\"(max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n<\/div>\n<\/div>\n\n<h4 class=\"wp-block-heading\">Recomand\u0103ri INRS  <\/h4>\n\n<p>Institutul Na\u021bional Francez pentru Cercetare \u0219i Securitate (INRS) recomand\u0103 <strong>men\u021binerea temperaturii ambientale<\/strong> \u00eentr-un mediu de lucru la un nivel la care riscurile pentru s\u0103n\u0103tate sunt reduse la minimum. Potrivit INRS, pericolele cresc atunci c\u00e2nd temperatura ambiant\u0103 dep\u0103\u0219e\u0219te 30\u00b0C pentru un angajat sedentar \u0219i 28\u00b0C pentru munca fizic\u0103. Peste 33\u00b0C, <strong>pericolele de insola\u021bie \u0219i deshidratare<\/strong> cresc considerabil, iar m\u0103surile preventive trebuie puse \u00een aplicare de urgen\u021b\u0103.  <\/p>\n\n<h2 class=\"wp-block-heading\">Obliga\u021biile angajatorului \u00een materie de siguran\u021b\u0103 termic\u0103<\/h2>\n\n<h3 class=\"wp-block-heading\">Evaluarea riscurilor legate de c\u0103ldur\u0103<\/h3>\n\n<p>Angajatorii au<strong>obliga\u021bia de a asigura s\u0103n\u0103tatea \u0219i securitatea angaja\u021bilor lor<\/strong>, inclusiv gestionarea c\u0103ldurii. Ei trebuie s\u0103 evalueze riscurile termice prin identificarea situa\u021biilor \u00een care temperaturile pot reprezenta un pericol pentru s\u0103n\u0103tatea lucr\u0103torilor lor. Aceast\u0103 evaluare trebuie s\u0103 ia \u00een considerare temperatura ambiental\u0103, umiditatea, tipul de munc\u0103 prestat\u0103 \u0219i durata expunerii la c\u0103ldur\u0103. De asemenea, evaluarea trebuie s\u0103 ia \u00een considerare efectele c\u0103ldurii combinate cu al\u021bi factori, cum ar fi <strong>volumul de munc\u0103 fizic\u0103<\/strong>, echipamentul utilizat \u0219i \u00eembr\u0103c\u0103mintea de lucru. Angajatorii ar trebui s\u0103 utilizeze instrumente adecvate, cum ar fi termometre \u0219i higrometre, iar \u00een condi\u021bii complexe, s\u0103 solicite sfatul exper\u021bilor medicali. Odat\u0103 ce evaluarea a fost efectuat\u0103, trebuie puse \u00een aplicare m\u0103suri preventive<strong>pentru a limita expunerea personalului la<\/strong> condi\u021bii periculoase, \u00een conformitate cu articolul L.4121-1 din Codul muncii francez.     <\/p>\n\n<h3 class=\"wp-block-heading\">M\u0103suri preventive care urmeaz\u0103 s\u0103 fie puse \u00een aplicare<\/h3>\n\n<div class=\"wp-block-columns is-layout-flex wp-container-core-columns-is-layout-28f84493 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\" style=\"flex-basis:66.66%\">\n<ul class=\"wp-block-list\">\n<li>Program de lucru flexibil<\/li>\n<\/ul>\n\n\n\n<p>Unul dintre primele lucruri pe care trebuie s\u0103 le lua\u021bi \u00een considerare atunci c\u00e2nd v\u0103 confrunta\u021bi cu vremea cald\u0103 este ajustarea orelor de lucru. Poate fi necesar s\u0103 se <strong>mute munca \u00een ore mai r\u0103coroase<\/strong>, cum ar fi diminea\u021ba devreme sau seara. De asemenea, ar trebui introduse pauze regulate pentru a permite angaja\u021bilor s\u0103 se odihneasc\u0103 \u0219i s\u0103 se rehidrateze. \u00cen plus, posturile de lucru \u00een aer liber trebuie s\u0103 fie echipate pentru a asigura o protec\u021bie adecvat\u0103 \u00eempotriva condi\u021biilor meteorologice extreme, \u00een conformitate cu articolul R. 4225-1 din Codul muncii francez.   <\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Furnizarea de ap\u0103 potabil\u0103 proasp\u0103t\u0103<\/li>\n<\/ul>\n\n\n\n<p>\u00cen conformitate cu articolul R. 4225-2 din Codul muncii francez, accesul la ap\u0103 potabil\u0103 trebuie s\u0103 fie garantat pentru to\u021bi angaja\u021bii.<strong>Angajatorul este obligat s\u0103 furnizeze<\/strong> suficient\u0103<strong>ap\u0103<\/strong> pentru a preveni deshidratarea, \u00een special \u00een mediile \u00een care lucr\u0103torii sunt activi fizic sau \u00een spa\u021bii restr\u00e2nse. <\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Ventila\u021bie \u0219i aer condi\u021bionat<\/li>\n<\/ul>\n\n\n\n<p>\u00cen conformitate cu articolul R. 4222-1 din Codul muncii francez, angajatorul trebuie s\u0103 garanteze o re\u00eennoire adecvat\u0103 a aerului \u00een spa\u021bii pentru a<strong> evita cre\u0219terile excesive de temperatur\u0103<\/strong>. \u00cen spa\u021biile \u00een care poluarea nu este specific\u0103, aceast\u0103 re\u00eennoire se poate face prin ventila\u021bie mecanic\u0103 (ventila\u021bie mecanic\u0103 controlat\u0103, de exemplu) sau ventila\u021bie natural\u0103 (prin ferestre, deschideri etc.) (articolul R. 4222-4). \u00cen <strong>mediile \u00een care c\u0103ldura este dificil de gestionat<\/strong>, cum ar fi atelierele sau fabricile, instalarea de sisteme de ventila\u021bie sau de climatizare poate fi esen\u021bial\u0103 pentru men\u021binerea unei temperaturi sigure \u0219i pl\u0103cute. \u00cen spa\u021biile industriale mari \u0219i deschise, <a href=\"https:\/\/obera.fr\/ro\/produits\/rafraichisseurs-air\/\">r\u0103cirea adiabatic\u0103<\/a> poate fi o alternativ\u0103 eficient\u0103 pentru asigurarea unor condi\u021bii de lucru adecvate \u0219i conforme.   <\/p>\n\n\n\n<p><\/p>\n<\/div>\n\n\n\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\" style=\"flex-basis:33.33%\">\n<figure class=\"wp-block-image aligncenter size-large is-resized\"><img decoding=\"async\" width=\"1024\" height=\"1024\" src=\"https:\/\/obera.fr\/wp-content\/uploads\/2024\/07\/3-1024x1024.jpg\" alt=\"Termometru cu s&#x103;geata &#xEE;ndreptat&#x103; &#xEE;n jos\" class=\"wp-image-33122\" style=\"width:255px;height:auto\" srcset=\"https:\/\/obera.fr\/wp-content\/uploads\/2024\/07\/3-1024x1024.jpg 1024w, https:\/\/obera.fr\/wp-content\/uploads\/2024\/07\/3-300x300.jpg 300w, https:\/\/obera.fr\/wp-content\/uploads\/2024\/07\/3-150x150.jpg 150w, https:\/\/obera.fr\/wp-content\/uploads\/2024\/07\/3-768x768.jpg 768w, https:\/\/obera.fr\/wp-content\/uploads\/2024\/07\/3-24x24.jpg 24w, https:\/\/obera.fr\/wp-content\/uploads\/2024\/07\/3-48x48.jpg 48w, https:\/\/obera.fr\/wp-content\/uploads\/2024\/07\/3-96x96.jpg 96w, https:\/\/obera.fr\/wp-content\/uploads\/2024\/07\/3.jpg 1200w\" sizes=\"(max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n<\/div>\n<\/div>\n\n<h2 class=\"wp-block-heading\">Drepturile angaja\u021bilor \u00een fa\u021ba temperaturilor ridicate<\/h2>\n\n<h3 class=\"wp-block-heading\">Condi\u021bii de exercitare a dreptului de retragere<\/h3>\n\n<p>\u00cen conformitate cu articolele L.4131-1-L.4131-4 din Codul muncii francez, angaja\u021bii au dreptul de a p\u0103r\u0103si locul de munc\u0103 \u00een caz de pericol grav \u0219i iminent pentru s\u0103n\u0103tatea lor. \u00cen cazul unei temperaturi foarte ridicate, dac\u0103 un angajat consider\u0103 c\u0103 <strong>expunerea la c\u0103ldur\u0103<\/strong> este susceptibil\u0103 de a provoca un prejudiciu imediat (de exemplu, un accident vascular cerebral), acesta poate p\u0103r\u0103si locul de munc\u0103. Acest drept trebuie s\u0103 fie exercitat \u00eentr-un cadru specific, iar<strong>angajatorul trebuie informat imediat<\/strong>.    <\/p>\n\n<h3 class=\"wp-block-heading\">Procedura de urmat \u00een caz de pericol grav \u0219i iminent<\/h3>\n\n<p>Atunci c\u00e2nd un <strong>angajat \u00ee\u0219i exercit\u0103 dreptul de retragere<\/strong>, acesta trebuie s\u0103 urmeze o procedur\u0103 specific\u0103:<\/p>\n\n<ol class=\"wp-block-list\">\n<li>Informa\u021bi imediat \u0219eful ierarhic cu privire la pericol.<\/li>\n\n\n\n<li>Justifica\u021bi retragerea sa prin explicarea riscului implicat.<\/li>\n\n\n\n<li>Documenta\u021bi incidentul \u00een cazul unui litigiu.<\/li>\n<\/ol>\n\n<p>\u00cen cazul \u00een care<strong>angajatorul nu ia m\u0103surile adecvate<\/strong> pentru a remedia situa\u021bia, angajatul poate decide s\u0103 p\u0103r\u0103seasc\u0103 locul de munc\u0103 f\u0103r\u0103 a risca sanc\u021biuni. Exercitarea dreptului de retragere nu trebuie s\u0103 conduc\u0103 la nicio sanc\u021biune sau deducere din salariu. Angaja\u021bii sunt liberi s\u0103 \u00ee\u0219i exercite acest drept la propria lor discre\u021bie. Pe de alt\u0103 parte, atunci c\u00e2nd via\u021ba sau <strong>s\u0103n\u0103tatea angajatului nu este cu adev\u0103rat \u00een pericol,<\/strong> lucr\u0103torul poate fi sanc\u021bionat.   <\/p>\n\n<h2 class=\"wp-block-heading\">Consecin\u021bele c\u0103ldurii extreme asupra s\u0103n\u0103t\u0103\u021bii lucr\u0103torilor<\/h2>\n\n<h3 class=\"wp-block-heading\">Riscuri implicate  <\/h3>\n\n<div class=\"wp-block-columns is-layout-flex wp-container-core-columns-is-layout-28f84493 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\" style=\"flex-basis:66.66%\">\n<p><strong>Insola\u021bia<\/strong>, deshidratarea, crampele musculare \u0219i oboseala sunt riscuri majore la temperaturi ridicate. Aceste fenomene pot duce la afec\u021biuni fizice grave \u0219i, \u00een unele cazuri, la spitalizare. Insola\u021bia, \u00een special, este o urgen\u021b\u0103 medical\u0103 care poate avea <strong>consecin\u021be fatale<\/strong> dac\u0103 situa\u021bia nu este tratat\u0103 rapid.  <\/p>\n\n\n\n<p>\u00cen plus, c\u0103ldura poate <strong>agrava patologiile preexistente<\/strong>, \u00een special cardio-respiratorii, renale \u0219i endocrine. Angaja\u021bii trebuie s\u0103 fie instrui\u021bi s\u0103 recunoasc\u0103 aceste semne \u0219i s\u0103 reac\u021bioneze rapid. M\u0103surile individuale de prevenire, cum ar fi purtarea de haine u\u0219oare \u0219i respirabile, pauzele regulate \u0219i consumul de ap\u0103, sunt, de asemenea, importante pentru <strong>evitarea pericolelor legate de c\u0103ldur\u0103<\/strong>.  <\/p>\n\n<h2 class=\"wp-block-heading\">Reglement\u0103ri specifice \u0219i m\u0103suri adecvate<\/h2>\n\n<h3 class=\"wp-block-heading\">Dispozi\u021bii pentru sectorul construc\u021biilor \u0219i lucr\u0103rilor publice<\/h3>\n\n<p>Lucr\u0103torii din construc\u021bii, \u00een special cei care lucreaz\u0103 \u00een aer liber \u00een timpul verii, sunt <strong>foarte expu\u0219i riscurilor asociate c\u0103ldurii \u0219i valurilor de c\u0103ldur\u0103<\/strong>. Pentru a limita aceste riscuri, trebuie introduse pauze regulate \u0219i trebuie asigurate ad\u0103posturi climatizate sau zone umbrite, \u00een conformitate cu articolul R. 4534-142 din Codul muncii francez. \u00cen plus, accesul la cel pu\u021bin 3 litri de ap\u0103 pe zi pentru fiecare lucr\u0103tor este obligatoriu (articolul R. 4534-143). De asemenea, se pot organiza ore de lucru flexibile pentru a <strong>evita perioadele cele mai fierbin\u021bi ale zilei<\/strong>. \u00cen caz de condi\u021bii extreme, angajatorul poate suspenda temporar activitatea.    <\/p>\n\n<h3 class=\"wp-block-heading\">Tinerii lucr\u0103tori<\/h3>\n\n<p><strong>Legisla\u021bia francez\u0103 acord\u0103 o aten\u021bie deosebit\u0103 tinerilor sub 18 ani<\/strong>, care sunt supu\u0219i unor restric\u021bii privind munca \u00een aer liber pe vreme cald\u0103. Din cauza sensibilit\u0103\u021bii lor crescute la c\u0103ldur\u0103, ace\u0219tia beneficiaz\u0103 de o protec\u021bie special\u0103.
